The Pueblo West Committee of Architecture ("PWCOA"), a Colorado nonprofit corporation,
also known as the "Committee", at a meeting this 24th day of July, 1997, at which
time a quorum was present, adopted the following Resolution to be effective this
24th day of July, 1997:

RESOLUTION 97-3

WHEREAS, the general purpose of PWCOA is to provide for the maintenance of a high standard of architecture and construction in such a manner as to enhance the aesthetic properties and structural soundness of the developed subdivision; and

WHEREAS, PWCOA shall be guided by and controlled by the Declaration of Reservations except when, in their sole discretion, good planning would dictate to the contrary; and

WHEREAS, PWDCOA is charged with a task of enforcing certain conditions, covenants and restrictions called the Declaration of Reservations (the "Declaration") respecting the development, improvement, protection, maintenance, and use of real property located in Pueblo West; and

WHEREAS, the Declaration provided that PWCOA may adopt reasonable rules and regulations in order to carry out its duties of providing for the maintenance of a high standard of architecture and construction in such a manner as to enhance the aesthetic properties and structural soundness of the community; and

WHEREAS, the Declaration states:

"No building, including farm structures of any kind, fence, patio, or other structure shall be erected, altered, added to, placed, or permitted to remain on said lots and nay of them or any part of any such lot until and unless the plans showing floor areas, external design, structural details and the ground location of the intended structure along with a plot plan have been first delivered to and approved in writing by the Committee. The Committee may require a reasonable fee prior to checking or appraising said plans…All residential, commercial and industrial structures shall conform to the requirements of the Uniform Building Code as published by the International Conference of Building Officials, current edition, and the requirements of the National Electrical Code, as published by the National Fire Protection Association, current edition, as a guide to sound construction and electrical installation practices and the Pueblo County Building Department, whichever are the more restrictive"; and

WHEREAS, the construction of "Plain Jane" structures or simple box-type residential homes neither maintain the high standard of architecture nor enhance the aesthetics of properties in Pueblo West; and

WHEREAS, PWCOA believes that based upon good planning, PWCOA should adopt the following guidelines for approval of residential construction on residential lots within the subdivision of Pueblo West.

THEREFORE, IT IS RESOLVED that the following architectural and design guidelines are adopted for the placement and construction of residential housing on residential lots in Pueblo West:

1. The guidelines for review of plans by PWCOA shall be one of assuring that the architecture and design of a structure does not result in "Plain Jane" appearance.  In determining whether a "Plain Jane" situation exists, a list of specific features to be considered includes, but is not limited to the following:

1. Ridge line (on peak-roofed structures) exceeding 2 to 2 ½ times the width of the structure;
2. Single front exterior surface exceeding 1 ½ times the width of the structure;
3 Single rear exterior surface exceeding 2 times the width of the structure;
4. Roof pitch on peak-roofed structures less than 4/12;
5. Absence of or inadequate exterior window treatments;
6. Absence of or inadequate stucco wraps or banding;
7. Inadequate roof overhangs.

2. PWCOA will not approve residential structures whose appearance is unacceptably influenced by one or more of the following characteristics:

1. Exterior walls forming a simple rectangle;
2. Long single-gable roof with no breaks inpeak or slopes;
3. Single-plane front exterior wall;
4 Plain front doorway that lacks enhancing features;
5. Plain exterior wall surface;
6. Main entrance located other than on front of structure.

3. The above architectural and design considerations shall be considered with the overall presentation and design of the proposed structures on a case-by-case basis for the purpose of enhancing the aesthetic properties and appearance of properties in Pueblo West.

The motion to adopt this Resolution was made, seconded and carried by PWCOA on the

24th day of July, 1997.
